These terms and conditions apply to all products (‘Products’) supplied by The UK Radio Astronomy Association ('UKRAA') with the exception of UKRAA’s Starbase software, which is governed by separate terms and conditions.
UKRAA is not currently VAT registered, so VAT is not charged on Product prices.
UKRAA reserves the right to decline to accept any order by notifying the Customer within a reasonable period of receipt of the order. This would only normally happen where a Product has been discontinued or is out of stock.
Times and dates for delivery quoted by UKRAA are approximate only. UKRAA will normally deliver Products within 30 days of receipt of the order and confirmation of payment, although UKRAA aims to despatch Products which are held in stock within 7-10 days.
Products are sent by Royal Mail, ParcelForce or courier and UKRAA obtains proof of posting. UKRAA will notify the Customer of despatch. If any delivery is late, the Customer must notify UKRAA, and UKRAA will endeavour to ascertain if the Product has been delivered or the expected delivery time of the Product to the Customer.
5. Inspection, Delivery Delays and Non-Delivery
The Customer should inspect the Products as soon as reasonably practicable after delivery and notify UKRAA of any apparent defect, shortfall or delivery of Products not in accordance with the order.
Payment terms are cash with order.
Risk of loss of or damage to the Products passes to the Customer on delivery.
8. Product and availability information
UKRAA may, without prior notice, discontinue any Product or make design changes as part of its continuous programme of product improvement.
UKRAA warrants that if any Product (excluding any software comprised in such Product) is defective it will, at its discretion, replace or repair the Product or refund the purchase price. This warranty is subject to a claim being made in writing to UKRAA within 12 months of the original date of despatch.
This warranty does not apply to any defect which arises from improper use, failure to follow the Product instructions, or any repair or modification made without UKRAA’s approval.
The Customer must return any defective Products to UKRAA, suitably packaged. The Customer must contact UKRAA to notify UKRAA of the return of any Products prior to returning it. Returned Products must be accompanied by a note stating the nature of any claimed defect.
Any Products which are replaced by UKRAA shall become UKRAA’s property. Title to replacement Products shall pass to the Customer on delivery, and the period of the replacement Product's warranty shall be the unexpired period of the defective Product's warranty.
The remedies set out above shall be UKRAA's sole liability and the Customer's sole remedy for any breach of
warranty and in respect of the supply or non-supply of Products and/or services.
UKRAA will not, save where its liability cannot be excluded or limited by applicable law, have any liability in respect of any claim relating to any Product apart from its warranty liability as set out above.
